On July 23, 1951, Dr. F. W. Hinkle filed a petition for divorce against his wife, Mrs. Selma Hinkle. On the next day, the wife filed a petition for divorce and alimony against her husband, and subsequently she filed an answer to his petition for divorce. On January 22, 1952, the two cases were consolidated for trial. The jury returned a verdict for total divorce, giving both parties the right to remarry, with alimony to the ""defendant, Selma Cochran Hinkle,"" in the sum of $300. The jury further found that the title to a described automobile was ""in the plaintiff, F. W. Hinkle."" Within thirty days Mrs. Hinkle filed a motion to set aside the verdict and judgment upon five grounds, and it was alleged that an approved brief of the evidence could not be prepared in ""the 30-day period allowed by law""; and the court was requested to permit the filing of an approved brief and any additional grounds to set aside, on a date fixed by the court. An order was duly passed granting an extension of time as prayed. A brief of the evidence was filed and approved by the trial Judge. The amended motion to set aside was duly allowed and approved.
